Preamble

These Terms and Conditions define the conditions under which EPREYN provides its online business management service to any individual or legal entity.

Any subscription to the Service implies full and complete acceptance of these Terms.

2 Service Description

Backhurry is an online SaaS platform that enables:

  • • Project and custom entity management
  • • Custom fields and automation creation
  • • Document generation
  • • Access to an intelligent assistant (AI)
  • • Integration via open API (WordPress, Zapier, Make, etc.)
  • • Secure data storage in the EU (Belgium)

The Service is available 24/7, subject to maintenance and technical incidents.

3 Registration and Account Creation

Registration is open to any adult individual or legal entity. Registration is done via Google Sign-In or a valid email address.

The Customer commits to providing accurate, complete and up-to-date information. They are responsible for the confidentiality of their credentials.

4 Free Trial Period

7-day free trial

No commitment • No credit card required

At the end of this period, the Customer either subscribes to a paid plan or access is suspended. Data remains recoverable for 30 days.

5 Pricing and Payment Terms

$10 TTC /month / user

Prices are shown in euros including VAT. Applicable VAT rate applies. Any price change will be notified 30 days in advance.

Payment is made by credit card via Stripe. Accepted cards: Visa, Mastercard, American Express.

In case of payment failure, new attempts are made for 14 days.

6 Duration and termination

The subscription is for an indefinite period, automatically renewed monthly.

Cancel anytime, free of charge, from the management dashboard.

Termination takes effect at the end of the current monthly period.

7 Right of Withdrawal

In accordance with Consumer Law, the right of withdrawal does not apply to digital content contracts whose execution has begun after consumer consent.

The 7-day free trial provides an equivalent guarantee.

8 Customer Data and Ownership

The Customer remains the sole owner of data they enter, import or generate via the Service.

Data is hosted by Google Cloud Platform (Firebase) in the europe-west1 region (Belgium), in compliance with GDPR.

Backhurry performs automatic daily backups with 30-day retention.

The Customer can export their data (JSON) or permanently delete their account at any time.

9 Customer Obligations

The Customer commits to:

  • • Use the Service in accordance with applicable laws
  • • Not attempt to bypass security measures
  • • Not store illegal content
  • • Respect intellectual property rights
  • • Protect login credentials
10 Service availability

Backhurry commits to ensuring Service availability 24/7, without guaranteeing 100% availability.

The Service may be temporarily interrupted for scheduled maintenance, technical incidents or force majeure.

11 Limitation of Liability

Backhurry cannot be held liable for interruptions due to force majeure, damages resulting from misuse, or indirect damages.

In case of proven fault, total liability is limited to the amount of subscriptions paid in the last 12 months.

12-16 Force Majeure, Modifications, Intellectual Property, Confidentiality

Force Majeure (12) : Neither party shall be liable for any failure resulting from a force majeure event.

Service Modifications (13) : Backhurry may modify the Service at any time. Substantial changes notified 30 days in advance.

Terms Modifications (14) : Substantial changes will be notified 30 days before taking effect.

Intellectual property (15) : The Service, its source code, design and trademarks are the exclusive property of EPREYN.

Confidentiality (16) : Each party commits to keeping exchanged information confidential.

17 Consumer Mediation

Any consumer with a dispute may use a free mediation service.

18-19 Contract Assignment and Applicable Law

Assignment (18) : The contract may be assigned by Backhurry to a third party with prior notice to the Customer.

Applicable Law (19) : These Terms are governed by French law. For professionals, Perpignan courts shall have jurisdiction.

20 Terms Acceptance

By checking the acceptance box during registration, the Customer acknowledges having read, understood and accepted these Terms.
